Court acquitted alleged militant in kidnapping
Issues arrest warrants against 2 militants

Jammu, Dec 13 (JNF): Principal Sessions Judge Poonch Kishore Kumar acquitted one Mohd Taj from the charges of kidnapping and issued General Arrest Warrants against Mohd Farooq S/O Mohd Hussain & Mohd Farooq S/O Mohd Hussain alleged militant of LeT outfit.
According to the police case, An FIR No.59/2004 came to be registered on the motion of an application filed by Barkat Bi alleging therein that on the intervening night of 26th and 27th of April 2004 she along with other Family members were present in the house and after taking the meals, her husband went to sleep and in the meantime some unknown persons armed with weapons entered the house. They asked her husband to accompany them to show the path and her husband did not return till morning. After the conclusion of the investigation the IO came to the conclusion that about 4 months ago the militants namely Mohd Taj,Mohd Farooq and Mohd Rashied had gone to the house of Aziz Din and were bent upon to abuse sexually the daughter of Aziz Din. The daughter of Aziz Din saved herself by jumping from the house and after this incident Aziz Din had migrated to Rajouri along with his family members. It is on 26th and 27th of April 2004 Aziz Din along with his family members came back for cultivating the land and he had informed the police and the civilians regarding the activities of the militants.
Because of this reason, with common criminal intention the accused person namely Mohd Taj, Mohd Farooq and Mohd Rashied kidnapped Aziz Din and has confined him in unknown place.
Principal Sessions Judge Poonch Kishore Kumar after hearing both the sides It is a settled principle of law that prosecution is under an obligation of proving the guilt of accused beyond reasonable doubt by cogent and clear evidence. In the present case prosecution has been unable to prove the guilt of accused beyond reasonable doubts by cogent and clear evidence. Hence accused Mohd Taj S is acquitted of the charges framed against him.
