| 4 yrs RI to then JE in trap case | | | Early Times Report Jammu, Feb 20 : Additional sessions Judge Anticorruption Jammu Jaffer Hussain Beigh today awarded four years imprisonment and fine Rs 4000/- to accused Mohd Bashir s/o FIaz Mohd r/o Gujjar Mandi Rajouri who was Junior Engineer Rural Development Block Kalakote in trap case. According to the Vigilance Case complainant Mandeep Sharma r/o Village Sair Tehsil Kalakote a contractor lodged a complaint with the Vigilance Organization Jammu alleging that JE Mohd Bashir was demanding Rs 10,000 as illegal gratification from him for releasing the payment of construction work executed by him. Upon this the VOJ registered a case against the accused u/s 5(2) PC Act 2006 BK r/w section 161 RPC and constituted a trap team headed by DySP Amanat Ali Shah. The team along with independent witnesses reached near the bar and restaurant where accused JE was sitting in the bar, the complainant Mandeep Sharma on demand handed over the tainted currency notes of Rs 6000/- to the accused Mohd Bashir JE, who in turn handed over Bills. Soon after this transaction the accused suspected the presence of Vigilance Team members in the Bar and become alert called the hotel manager Virinder Sharma immediately and handed over the accepted bribe amount to him for crediting the same into his account and tried to escape from the Bar and Restaurant. His attempt to escape was foiled by the Vigilance Trap team and arrested the accused on spot. After completion of investigation challan was presented in the Court. Additional sessions Judge Anticorruption Jammu Jaffer Hussain Beigh after hearing CPO Anil Magotra with Senior PO Himanshu Gupta for the Vigilance Organization whereas Adv Nazir Ahmed Choudhary appearing for the accused persons, observed that the evidence on record it is proved beyond reasonable doubt that the accused Mohd Bashir in the capacity of Public Servant as Junior Engineer Block Kalakote demanded Rs 6000/- from the complainant as illegal gratification . Court sentenced the accused Mohd Bahir to undergo rigorous imprisonment for two yrs u/s 161 RPC and also undergo rigorous imprisonment for two yrs and fine of Rs 4000 u/s 5(1) (d) PC Act. Court said that both the sentences shall run concurrently. The accused who was present in the Court was taken into custody and sent to District Jail Jammu for undergoing the sentence. |
