| Alleged militant guide acquitted, arrest warrants against two Pak militants | | | Jammu, Feb 20 (JNF) : Principal Sessions Judge Kathua MK Hanjura today acquitted one Gaya alleged guide of militants, as prosecution failed. According to the police case that on April 23, 2005, police party discovers a bag at "Shap Nallah" under suspicious circumstances. On the search bag two AK-47 Rifles, 10 Magazines of AK-47 Rifles, 260 cartridges of AK-47, a wireless set, a FM transistor with antenna, rifle grenades, a compass grenades, some medicines and other related items were recovered. The arms and ammunition discovered were lying in a state that created suspicion about the presence of terroirts in the area. These were seized and a case u/s 121/12-A/120-B RPC and 7/27 Arms Act was registered at P/S Rajbagh. During the investigation it reveals that accused Gaya and Qasim Din had acted as Guides of the militants. During the course of Trial Qasim Din died and the proceedings are dropped against him. Principal Sessions Kathua MK Hanjura after hearing PP Ravi Kumar Gupta for the state whereas Adv Kirti Bhushan appearing for the accused, observed that the prosecution have not stated anywhere in their statement, that the accused Gaya & Qasim (who was died) acted as the Guides of the militants or provided them the information about the topography of the area or escorted them to the hilly terrains or provided them food and shelter or any material. Court further observed that there is no evidence on record against the accused from where his links can be traced with the commission of the offence leveled against him. Under these circumstances it merits the acquittal of the accused. In this contest the accused Gaya is acquitted of the charge leveled against him and stand released from the custody. Court issued General Arrest Warrants against accused Abu Tallah and Abu Farman both residents of Pakistan. |
