| Principal Sessions Judge Kathua denies bail to rapist | | | Et Plys Report
Jammu, Mar 15: Principal Sessions Judge Kathua MK Hanjura Friday dismissed the bail application of one Munir Hussain who has allegedly raped a minor girl. According to police on December 24 last year, the mother of the prosecutrix reported the occurrence at police station Raj Bagh stating that the accused repeatedly raped her minor daughter for a period of two and half months approximately near Ujh river where she used to graze cattle. She also stated that as a consequence of the alleged rape she is in state of pregnancy. A case was registered u/s 376 RPC. As per the school record the prosecutrix is said to be born in the year 1997 and her age has been put at 17/19 yrs by the radiologist. The accused is in custody since December 26, 2012. The court after hearing Advocate Bharat Bhushan Sharma for the accused and Public Prosecutor Ravi Kumar for the state observed that minor girl was allegedly raped by the petitioner for two and a half months. "She is pregnant. This has changed the entire dimension of the case. The law on the subject is clear that the grant of bail depends upon the nature of the offence, the manner in which it is committed and its impact on the society and referred a judgment of the Supreme Court and further observed that a pandentic view of matter cannot, therefore, be had in the instant case taking into consideration the peculiar circumstances under which the crime has been committed and dismissed the bail application," the court observed.
