Jammu, Oct 4: In a petition filed by Minister of State (MoS) Dr Manohar Lal seeking quashment of order passed by the Judicial Magistrate, 1st Class, Billawar, or, in the alternative, judgment and order dated 06.03.2012 passed by the Court in Cr. Rev. No.87/2005, on the grounds taken in the petition, the High Court allowed the petition and recalled 6 March 2012 order and dismissed the criminal revision petition and close the proceedings against Dr Lal. The case of the petitioner is that the Magistrate, who had issued the show cause notice while making the judgment and order dated 12.03.2005 in FIR No.46/2000, Police Station Billawar, has the power to pass appropriate orders in terms of Section 250 Cr.P.C. Thus, the proceedings conducted and the order passed by this Court in Cr. Rev. No.87/2005 is not in accordance with the Apex Court judgment. Justice Mansoor Ahmed Mir of State High Court Jammu after hearing senior advocate B S Salathia with advocate Meenakshi Salathia for the petitioner and AAG Seema Shekhar for the state, allowed the petition and recalled order March 6, 2012 and dismiss the criminal revision petition and close the proceedings ( issuance of show cause notice against Dr. Manohar Lal). |
