Gool Firing: SIT produces challan, CJM Ramban transfers case to 'BSF Court for trial'

Ramban, Dec 12: Special Investigating Team (SIT) constituted for investigating FIR No 55/2013 of P/S Gool in which 4 persons were killed and 42 were injured on July 18, 2013 at Village Dharam (Gool) after firing on mob protesting against the alleged desecration of Holy Quran presented challan against six BSF personnel for their alleged involvement in Firing incident and transferred the case to BSF trial Court. The challan was produced against CT S K Sikdar (No.88006834); CT D Shill (Belt No.0821039); CT S Sardar (Belt No.08201040); CT Manoj Kumar (Belt No.11135058); ASI Charanjeet Singh (Belt No.88005020) and ASI A K Brahma (Belt No.86766010) all posted with 76 BN BSF Dharamkund in the Court of Chief Judicial Magistrate Ramban. CJM Ramban M R Chak after receipt of the challan gave an option in terms of Section 549 Cr PC as to the trial of the accused. Earlier Dy Inspector General, BSF has made an application through Dy Commandant namely Manohar Lal presently posted at 76 BN at Dharamkund Gool in terms of Section 80 of BSF Act 1968 read with Section 549 of the Code of Criminal Procedure requesting this Court to hand over charge sheet alongwith above named accused for being tried before Border Security Force Court. The above mentioned accused who have been produced before this Court, already been detained by the BSF authorities as is evident from the order No.Estt-1/COB Dharam/SHQ-SBN/2013/9548-52 dated 23rd of July, 2013 passed by Surjit Singh Dy Inspector General of BSF Headquarter at Sunderbani. Dy Inspector General of BSF has authorized Dy Commandant Manohar Lal to collect the requisite documents i.e. charge sheet and seized property including custody of the accused present in the court.
CJM Ramban in view of the mandate of Section 549 Cr. PC and in view of the written requisition made by Dy. Inspector General of BSF, the charge sheet alongwith accused present in the court are handed over to authorized officer i.e. Dy Commandant Manohar Lal for their trial before the Border Security Force (BSF) Court. The outcome of trial to be conducted by Border Security Force Court shall be intimated to this Court in due course of time. Office shall hand over charge sheet to the officer against property receipt. An index shall be prepared which after its due compilation shall be consigned to records. (JNF)
