| Fanatics ask Govt to celebrate Nov 17 as Republic Day in J&K | | Wrecking the polity | | Neha JAMMU, Dec 12: It was widely believed that Article 370 of the Indian Constitution had created republic of Jammu & Kashmir within the Indian Republic in 1950 and that was the reason the nationalist constituency in the country and integrationists opposed the Congress' sinister move. The attitude of the integrationists and well-wishers and friends of India and the people of the state remains the same even today. That their stand on Article 370 was as it should have could be seen from what has been going on in the state since 1950. And what a fanatic and separatist did in Kashmir the other day should leave none in any doubt that Article 370 has created an impression in Kashmir that Jammu & Kashmir is a republic within the India republic that needs to celebrate its own republic day. In other words, it has led the fanatics and separatists in Kashmir to believe that Jammu & Kashmir is a separate country. What happened in Kashmir the other day? A Public Interest Litigation (PIL) was filed in the Jammu & Kashmir High Court seeking "directions to all Constitutional authorities under the Constitution of Jammu & Kashmir to celebrate November 17 as the Republic Day of Jammu & Kashmir as it was on this day in 1956 that people of the State (read the wholesale rigged constituent Assembly controlled by Jawaharlal Nehru-supported Sheikh Abdullah of National Conference) adopted their Constitution". The petition was filed by 61-year old Abdul Qayoom Khan of Rajbagh, Srinagar, through senior counsel Z A Shah (a known separatist), which has sought "directions to the constitutional authorities of the state to use the state flag in their official cars and offices". "Non-hoisting of the flag of the state by all the constitutional authorities created or who function under the Constitution of Jammu & Kashmir, including Governor, Judges of the High Court, Cabinet or State Ministers and all other authorities, constitutes serious breach of the Constitution and the law as is in vogue in the State of Jammu & Kashmir," the petition has said, adding that "what Indian flag means to the people of India, the state flag means the same thing to the people of Jammu & Kashmir" (read Kashmir and not Jammu and Ladakh, as the people of these two regions want the state constitution to go lock, stock and barrel on the ground that it has jeopardized their legitimate social, economic, political and fundamental rights, including the right to lead a dignified life as a full-fledged Indian citizen). Abdul Qayoom Khan through his seditious PIL has urged the High Court to direct the constitutional authorities to discharge their obligations towards the state constitution by using, unfurling and hoisting the state flag wherever required on buildings, properties of the state located not only within the state but also outside it, official cars and by organizing and celebrating November 17 as the Republic Day of the state when the Jammu & Kashmir Constituent Assembly adopted, enacted and gave to the people the Constitution. All constitutional authorities are bound to use the state flag, the petition has also said. "So long as a constitutional authority is created by the constitution of the state, it is under an obligation to use the state flag, the constitutional authority has no choice but to use the state flag in order to demonstrate the sanctity of the flag and republic character of Jammu & Kashmir," the petition has, in addition, said. Not just this. The PIL has also said: "Contrary to the constitution under which constitutional authorities have been created and function, these authorities only use Indian National Flag and no other flag. This has the effect of showing contempt to the constitution of the State. Such a situation has to be prevented". The Petitioner has, in a nutshell, put forth a demand which, if accepted, would only facilitate the state's separation from India. There is no doubt that the High Court would dismiss this seditious PIL. That's not the issue. The issue is insidious influence is at work in Kashmir to undo all that the Indian nation did during all these years of accession to integrate the state fully into India and enable the people of the state to exercise the rights available under the Indian Constitution. |
