| HC directs Commissioner/Secretary to reconsider petitioner for post of JE | | | ET Report
Jammu, Jan 8 : Vacation Judge of J&K High Court Jammu Wing Justice BL Bhat today directed Commissioner/Secretary Works to reconsider the claim of petitioner against the vacant post and strictly adhere to the terms of order dated 23rd January, 2013 passed in SWP No.171/2013 and take a decision in regard to the petitioner's claim qua vacant positions indicated in the order.
The decision shall be taken within the notice period. Petitioner is aggrieved of Government Order No. 189-PW (R&B) of 2013 dated 06.06.2013 in terms whereof his claim has been rejected on the ground that the same was found without merit. It is pointed out that the impugned order has not been passed in compliance to the judgment rendered by this Court in SWP No.171/2013 dated 23rd January, 2013 by virtue whereof respondents were directed to accord consideration to petitioners' claim against vacancies advertised vide Notice No.8/2010 dated 24.12.2010 that have remained unfilled as on date, in view of the non joining of the selected candidate. It is further pointed out by Adv NP Kotwal that respondents were required to consider the claim against the unfilled vacancies and not to consider the petitioner's claim on merit. Justice BL Bhat after hearing Adv NP Kotwal issued notice to Commissioner/secretary Works, Chairman SSRB, Director RDD and Chief Engineer PMGSY returnable within four weeks.
