| HC puts promotion of I/C Divisional Manager SFC on hold | | | Et Report
Jammu, Jan 23 : Vacation Judge of J&K High Court Jammu Wing Justice Dhiraj Singh Thakur today stayed promotion of Asif Ali Nazar as I/C Divisional Manager in J&K State Forest Corporation Justice Dhiraj Singh Thakur after hearing Adv FS Butt appearing for the petitioner issued notice to Commissioner/Secretary Forest Dept, Managing Director J&K State Forest Corporation and Asif Lai Nazar promote and observed that petitioners challenged the order dated December 31, 2013 passed by Managing Director J&K SFC whereby Asif Ali Nazar has been posted as Incharge Fair Price Division, Srinagar which is stated to be in violation of J&K State Forest Corporation Employees (condition of service) Amended Regulations 2011 inasmuch as, for the purpose of promotion to the post of Divisional Manager, the person out to have put in five years of service as Assistant Divisional Manager. It is stated that Asif Ali Nazar was promoted as Timber Testing and Passing Inspector in the year 2010 which was a post equivalent to the Divisional Manager -I. counsel for the petitioners submits that the post of Divisional Manager-I was subsequently, re-designated as Assistant DM by virtue of order dated July 27, 2010 and on that touchstone, counsel for the petitioners submits that private respondent was not eligible for the promotion to the post of I/C DM on substantive basis inasmuch as he did not have five years service as Assistant DM. Adv FS Butt further submitted that no such arrangement on Incharge basis could be made by which private respondent would be made entitled to hold the post of DM on Incharge basis. Justice Dhiraj Singh Thakur after hearing counsel for the petitioners in length admit the petition for hearing and directed therespondent to file objections within six weeks and in the meanwhile till next date, the operation of impugned order dated December 31, 2013 shall remain stayed.
