| CBJ files objections in Ex-Principal GMC's application | | Spurious Drugs Scam | | ET Report
Jammu, Jan 23 : In the much publicized Spurious Drugs Scam case, Crime Branch Jammu has filed objections in the application filed by Dr. Anice Choudhary then Principal GMC Jammu filed before Special Judge Anticorruption Jammu seeking registration of case against then SSP, Crime branch & the Investigating Officer, being public servants have framed incorrect record with intent to save Yogesh Sharma & Mrs. Lotika Khajuria from punishment, besides committing a grave offence of destruction of evidence by erasing the signatures of a member from the minutes of the meeting & suppressed the true facts in the Supplementary challan leading to exoneration of these two members of the Purchase Committee II. In the objections crime Branch submitted that applicant Dr. Anice Choudhary accused in the this case was an important member of the Purchase Committee-II, who had not only taken part in all the meetings, but had also presided over some of the important meetings convened by the Purchase Committee-II regarding supply of drugs. The culpability of the accused/applicant Aniece Choudhary and other members of Purchase Committee-II, GMC, Jammu has been fixed for their role in clearing the deficient, fake and fictitious tender documents of the firm M/s Lifeline Pharmaco Surgicals, which did neither conform to the specifications nor were in consonance with the conditions of the tender notice. The tender documents submitted by the accused proprietors of the firm who had participated in the tendering process had been checked and scrutinized in two important meetings on 20.04.2012 and 07.05.2012. On 20.04.2012, the technical bids of all the tendering firms were opened / checked in a meeting chaired by accused Aniece Choudhary as Vice Chairman of Purchase Committee-II and other members. On 07.05.2012, the accused Aniece Choudhary and other members had also attended the meeting which was chaired by the Chairperson, Dr. Madhu Khullar wherein after scrutiny of the documents of 89 tendering firms, 57 firms including M/s Lifeline Pharmaco Surgicals were approved and 32 firms rejected. In both these meetings, the attendance register maintained by the Purchase Committee-II and seized by Crime Branch, Jammu wherein the signatures of the participating members are appended is a definite proof against the accused Aniece Choudhary and others for their criminal negligence, which has been accepted by the Government, whereupon the sanction for launching prosecution against the in-service officials has also been accorded. Documentary, circumstantial and oral evidence collected during the course of investigation leaves no room for any doubt as to the culpability of the accused Aniece Choudhary and others. It is further submitted that the Dr. Anice Choudhary has not only levelled false allegations against the investigation agency through the medium of the instant application but has got the contents of his frivolous application published in the newspapers, in order to bring a bad name to the premiere investigating agency for which the accused is required to be reprimanded and directed to refrain from indulging in such activities in future and his present application is required to be dismissed with exemplary costs. Crime Branch Jammu prayed before the Court that the application filed by the Ex-GMC Principal Dr. Anice Choudhary may be dismissed with heavy costs in the interest of justice & fair play and the regular proceedings of the trial of the case may be initiated after formal framing of charge against the accused persons. Special Judge Anticorruption Jammu after gone through the objections filed by the Crime Branch and hearing CPO Kulbushan Sharma with Senior PO MA Almansoor appearing for the Crime Branch and battery of advocates for the accused persons, fixed February 11, 2014 for further proceedings in the case.
