| Govt misuses Art 370, denies rights to people:AIBCU | | | Early Times Report
JAMMU, May 20: All India Backward Classes Union, (AIBCU) has taken the coalition Government to task for denial of Constitutional rights to State Subjects of J&K. In a letter to Chief Minister, Omar Abdullah the Union alleged that the coalition has deprived the OBCs of 27 percent reservation as recommended by Mandal Commission report. The letter said that all reservations including the RBA which are covered under Article 16 (1) has to be adjusted in horizontal reservation, a process which is already being carried out for ex-servicemen and handicapped persons under para 95 of the Apex Court judgment of 1992 on Mandal report. The Union in its letter to CM suggested in case the Government wants to provide reservations to any other category it can apply the formula of Para 95. The letter further said that the Government had assumed that there were no OBCs in Kashmir Valley and so they denied reservations to this category but after the Lok Sabha elections it has been proved that OBCs totally voted against the NC in Valley that resulted into party's rout. Criticizing the State Government's new recruitment policy the letter said that providing Rs 3000 or Rs 5000 under the policy to newly recruits has generated a lot of anger among the educated youth in the State and they too voted against the coalition partners. Moreover the widening gap between the low paid employees and high paid employees in every pay commission has been cause of concern among the State Government employees. In comparison to this the Central Government employees are satisfied with Pay Commission. It said the difference in pay should in no way be two and half times more. The letter said while thousands of posts are lying vacant in the State Government departments the Government has stick to policy of adhocism by making appointments on contractual basis, re-employing the retired persons etc. This has been a cause of concern among the youth who too revolted against the coalition, it added. On West Pak refugees the letter said that the Government was totally callous towards them as they have been the victims of partition and later they were denied the rights in the State too which is an injustice with these hapless people. Moreover the anti people policies of the Government has added to the woes of the people of State who have even been deprived of the ration in time and face power as well as water crisis. Maintaining that the Union was not opposed to Article 370 but it accused the Government of misusing this article and depriving the State subjects of J&K also of various benefits which they have been granted under Constitution of India. |
