| DB issues several directions | | PIL regarding establishment of Center for Transplant of organs | | Early Times Report
Jammu, May 20 : In a Public Interest Litigation filed by Smile Social Youth Club through its President Matloob Saleem Qureshi raising an important issue of regarding facilities for organ transplant, Division Bench of State High Court Comprising Justice Mohammad Yaqoob Mir and Justice Dhiraj Singh Thakur observed that in compliance to order dated October 29, 2013, an affidavit has been filed by Commissioner Secretary to Government, Health and Med. Education Department, wherein it has been admitted that as per the information furnished by the Principal, Government Medial College, Jammu and Principal, Government Medical College, Srinagar transplantation of Human Organ facilities are not available in the said Government Medical Colleges. Permission was granted to start Kidney Transplant Facilities (Urology Division) in the said two Medical Colleges but that could not be started due to non-availability of funds and necessary infrastructure. Division Bench further observed that in the affidavit it has been submitted that the matter was again taken up with both the Principals to furnish detailed proposals regarding establishing of different Organ Transplant Facilities in their medical colleges with funds required for the purpose vide communication No. ME/Legal/Genrl./2013/47-S dated 05.03.2013. Both the Principals were asked to furnish the proposals within two weeks positively and accordingly an application was filed by the Commissioner/Secretary Health & Medical Education before this Court to grant six weeks time to file status report in the matter." Upon this Division Bench said that it has been further stated in the affidavit that on receiving relevant detailed project report/proposal, the follow up action will be taken and directed that Principals of both the Colleges shall ensure that detailed project report/proposal is submitted to Commissioner/Secretary Health & Medical Education within shortest time preferably within four weeks and Commissioner/Secretary Health & Medical Education shall monitor the same well within time. During the course of arguments, counsel for the PIL also highlighted that the faculty position in Medical Colleges is not upto mark and the patients are suffering badly, upon this Division Bench directed Adv Naveent Dubey shall file a detailed application in this behalf.
