Court denies bail in Kishtwar slogan shouting case

JAMMU, Oct 18 : Principal Sessions Judge Kishtwar Bala Joyti today rejected bail application of one Mudassar Nazar who was arrested by Jammu and Kashmir Police (JKP) for allegedly raising 'Azadi' slogans in Kishtwar after the Eid-ul-Azha prayers.
Principal Sessions Judge Kishtwar Ms Bala Joyti after hearing Advocate M.H.Waza appearing for the applicant and Public Prosecutor for the state observed that Mudassar Nazir and Saqib Majeed have sought to be enlarged on bail as they have been arrested in connection with FIR No.218 /2014 registered at PS Kishtwar dated 06.10.2014 U/s 153-A 120-B/124-A RPC on the ground of allegedly promoting enmity on the auspicious day of Eid-ul-Azha. They have been accused of disturbing peace and tranquillity besides hurting sentiments of the nationalists by raising antinational slogans. Principal Sessions Judge Kishtwar Bala Joyti further observed that raising antinational slogan is sure to pollute the serene atmosphere of any place and this is a known fact that Kishtwar is a very sensitive township as it has seen many events of this nature when public tranquillity was imperilled by anti-national elements. Court noted with pain that bruises caused by such elements during last Eid celebration have not healed as yet and any such attempt by any person is sure to cause ripples in the process of restoring peace in this sensitive station. Crime in such cases is not against any individual but against whole society. With these observations, Court rejected the bail application of Mudassar Nazar and in case of Saqib Majeed whose age is stated to be 16 years (Less than 18 Years), his cases is to be dealt with U/S 13 of the J & K Juvenile Justice (Care and protection of Children) Act. Principal Sessions Judge Kishtwar Bala Joyti observed that in view of the settled position of law accused Saqib Majeed, who is below 18 years of age, as per Matriculation certificate is directed to be released from custody in this case, on furnishings a bail bond and personal recognizance of Rs. 20000 each.
