Jammu, Jan 7: Principal Sessions, Judge, Jammu, R S Jain today rejected the bail application of Asif Majid and Shabir Ahmed who were facing trial in a NDPS case. According to the police case, a patrol party of Gangyal police station on November 16, 2014, stopped a truck No JK03D/7912, which was being driven by Shabir Ahmed. Asif Majid was also sitting in the truck. On checking, two bags of poppy straw were recovered from the truck. As per the FSL report, the sample taken was identified as poppy straw in which morphene was detected. Accordingly FIR No 158/2014 for offence under section 8/15 of NDPS Act was registered at Gangyal police station against the accused persons and on conclusion of the investigation, police found the accused guilty of offence under section 8/15 of NDPS and Act presented the challan against the accused persons. The judge observed that in the present case, accused were having in their possession 40 kgs of poppy straw. The question arises should the accused be keeping such a large quantity of poppy straw in their possession and if they are keeping the illicit drug in such a large quantity in their possession while on the street, it cannot be obviously for their personal use but rather to deal in illicit trade of selling the same to the drug addicts. Keeping in view that the enactment of the NDPS Act is to curb the ever increasing menace of drug peddling and illegal sale and its ramifications on the society and the youth in particular and cause for increase in the crime rate, nature and seriousness of accusation against the applicants, the character of evidence, circumstances which are peculiar to the accused, in the larger interest of the society and the state, this court is of the view that no good ground is made out by the accused for enlarging them on bail. With these observations, the court rejected their bail application. (JNF) |
