On SIC's intervention, ADC gives info on brick kilns in Budgam

Srinagar, Jan 23: After being summoned personally for hearing, the Additional Deputy Commissioner (ADC) Budgam has provided copies of brick kiln licenses issued in the district during last several years. The information was earlier denied by the ADC who is also the designated Public Information Officer (PIO) but has been in news for violating the provisions of J&K RTI Ac 2009.
Details available with Early Times reveal that an application under RTI was filed by one Abdul Qayoom Mir S/O Ghulam Mohammad Mir R/O Peer Bagh Budgam on March 26th 2018 under J&K RTI Act 2009 seeking information of Brick Kiln licenses issued by DC Budgam from License No.01/DCB/283 to license No.50/DCB/.
As the information seeker was not provided any response from by the erring Additional Deputy Commissioner (ADC) who is also the designated Public Information Officer (PIO) , Mir filed First Appeal with D C Budgam on 15.05.2018 who is the designated First Appellate Authority (FAA). Feeling aggrieved , appellant filed 2nd Appeal before the State Information Commission (SIC) on 09.10.2018 submitting there under that not only the PIO has failed in providing him the information but the Deputy Commissioner Budgam who is the designated First Appellate Authority (FAA) under J&K RTI Act 2009 has also failed to dispose of his First Appeal.
The 2nd appeal came up for hearing before the State Information Commission (SIC) on 14.01.2019. State Information Commissioner M A Mir in his final order said though the information / the details of the licenses issued by D C Budgam from License No.01/DCB/SC to 45/DCB/2014 have been furnished to the appellant. However, the appellant submitted that he has not received the said communication.
SICs order reads :
"A copy of the said communication which was available with the PIO was handed over to the appellant during the course of hearing. The appellant expressed his satisfaction over the information received by him. However, he submitted that in fact he wanted to know the veracity of Licence issued in favour of one Sh. Bilal Ahmad Bhat S/o Gh. Hassan Bhat bearing Licence No.34/DCB/2013 issued on 03.08.2013. This licence is not included in the list of licences issued by D C Budgam which has been furnished to the 3 appellant. The PIO is accordingly directed to verify the genuineness of the licences shown to have been issued in favour of Sh. Bilal Ahamd Bhat S/o Gh. Hasssan Bhat bearing Licence N.34/DCB/2013 issued on 03.08.2013. In case said licence is not found to be genuine, the appellant shall be informed accordingly. With the said observations, the 2nd appeal is disposed of.
