| DB terminate services, directs Secy School Education to conduct enquiry | | Appointment of ReT | | Early Times Report
JAMMU, Feb 10: A Division Bench of J&K High Court comprising Chief Justice Gita Mittal and Justice Rajesh Bindal while deciding a LPA, terminated the appointment of Priti Rani as her engagement as ReT teacher and termed the same as erroneous and in violation of Rules.
The DB after hearing Advocate Monish Chopra and AAG Aseem Sawhney observed that it is also noteworthy that a list had to be initiated in order to bring the illegality to light and fix responsibility of the person involved in illegal appointment. Valuable judicial time was expended before the wrongful appointment, which continued for a long period of three years, was brought to an end.
The DB directed Secretary School Education Department to get an enquiry conducted by an officer not below the rank of Director into the circumstances in which the appointment of respondent No. 5 was made, as also apportion the responsibility.
The DB observed that inasmuch as, the appointment was wrongly made, the present case is a fit case where the salary, which was paid to the respondent deserves to be recovered from the person(s) who effected wrong selection and appointment. The DB directed that the enquiry is completed within a period of two months from the receipt of copy of the order. |
