H&UDD starts action against corrupt officials, suspends & attaches Secretary

SRINAGAR, Feb 10: The Housing & Urban development Department has started taking stern action against the fake appointments, irregularities, up gradations and promotions that have been made by the incompetent authorities from time to time. The department suspended and attached its official who was claiming for the grants from the said department.
Directorate of Urban Local Bodies Kashmir issued a suspension/attachment order vide no: DULB/Estt/8921/20 of 2020 Dated 04/02/2020.
The order reads, whereas, during the inspection of office in the Directorate on 04/02/2020 at 2:45 PM, Mr Mukhtar Ahmad Bhat, secretary presently working in the town drainage division Kashmir was found un-authorizedly absent from duties.
Whereas, it has been observed that Mr Mukhtar Ahmad was earlier also found un-authorizedly absent from duties without prior permission/leave from the competent authority, reads the order.
The order further reads that, whereas, as per the provisions of the civil service regulations/service conduct rules an employee is required to be punctual towards his legitimate duties and shall not remain absent without prior permissions/sanction of leave by the competent authority.
Whereas remaining absent from duties without proper permission/sanction of leave by the competent authority is a serious omission and warrants for strict disciplinary action under rules, the order mentions.
It further reads now, therefore in view of un-authorized absence from duties Mr Mukhtar Ahmad Bhat, secretary, town drainage divison Kashmir is hereby placed under suspension and attached with Municipal Committee Ganderbal with immediate effect, adding the charge sheet shall be issued to the suspendee separately.
Sources told Early Times that, earlier the official had tried his level best to mislead the department concerned to grant all the benefits whatsoever, but after thorough examination the department rejected his case.
After threadbare investigations, the Housing & Urban development Department, government of Jammu and Kashmir issued an order vide no: 39-JK (HUD) of 2020 dated 29-01-2020.
The order reads that, whereas Mukhtar Ahmad Bhat working as secretary in the DULB Kashmir has filed writ petition SWP NO;1447/2018, titled Mukhtar Ahmad Bhat Vs State of J&K and ors in the Hon’ble Court asking for following relief, to quash the government order no: 85-HUD of 2018 dated 19.03.2018, to pay and release the pay scale/grade attached to the post of section officer with retrospective effect from the date the petitioner has been promoted/adjusted as section officer i.e. 06/12/2006 with all other consequential benefits attached to the said post, to promote the petitioner to next higher post i.e Administrative officer.
In the last paragraphs of the above mentioned order, the department concerned mentioned in their order that, whereas in terms of Jammu and Kashmir Administrative Officers (G) service recruitment rules, 1996, the post of section officer is the feeding cadre for the post of administrative officer, whereas the petitioner is working against the post of secretary, even which is in violation of norms and is not the feeding cadre for the post of administrative officer.
Now therefore in compliance of the Hon’ble High Court order dated 26/09/2018 passed in I.A No.02/2018 in SWP No. 1447/2018 titled Mukhtar Ahmad Bhat Vs state of J&K and Ors, the case of the petitioner has been examined and considered in the department and the same is found devoid of any merit and hence rejected, reads the order.
