How can each member of family have separate BPL ration card? | RTI Activists miffed at SIC's order | | Early Times Report Srinagar, July 23: As State Information Commission (SIC) has ordered that information cannot be provided free of cost to an information seeker who has the below poverty line (BPL) ration card but that belongs to the family head like father or mother. The RTI activists have demanded that SIC must revisit this order as each and every member of the family cannot own a ration card whether the family belongs to BPL or an APL category (above poverty line ) . Pertinent to mention that SIC denied to provide information free of cost to an RTI applicant from south Kashmir's Shopian district , who had attached a copy of BPL ration card with his RTI applicantion and the BPL card was issued in the name of his father (family head). As per details available a complaint was filed before the State Information Commission (SIC) on 11.06.2014 by one Nisar Ahmad Bhat /so Ghulam Rasool Bhat a resident of Audoo, Shopian district against Executive Engineer (Xen) PHE Department Shopian stating that he filed an RTI application before Xen PHE Shopian on 15.04.2014, but PIO did not provide the information to him. Thus, under section 7(2) of the RTI Act it is deemed refusal of the information. He accordingly requested the Commission to direct the PIO to provide information and also action as per rules and sections of RTI Act 2009. The RTI applicant had sought information related to execution of various Government schemes by PHE in Shopian , appointments made by the department in Shopian , details of water connection holders etc. The RTI application was accompanied with photocopy of BPL card in the name of Ghulam Rasool Bhat who happens to be the father of the RTI applicant (information seeker) . During proceedings in the SIC office Srinagar on June 30th Rafiq Ahmad Wani Assistant Executive Engineer (AEE) PHE Division Shopian submitted that information has been delivered to the complainant on 22.06.2014. Complainant (Nisar Ahmad Bhat) admitted before the SIC to have received the information on payment of charges and the information was not provided free of cost to the RTI applicant inspite of the fact that he belonged to a BPL family. While talking to Early Times RTI activist from Srinagar Dr Mushtaq Ahmad Khan said that each and every member of the BPL family cannot own a ration card as that is being allotted to only one member of the family who usually is called the head of the family. "If son or daughter of the head of the family wants to seek information , how can he or she have a separate BPL ration card ? In such cases the BPL ration card supplied in favour of the head of the family should be accepted and the whole family should be treated as BPL family" Dr Mushtaq added. |
