DB seeks details about action taken against dealers distributing 'stained relief' to flood-hits | | | Early Times Report
Srinagar, Dec 12: A Division Bench (DB) of Jammu and Kashmir today directed authorities to provide details about the actions taken against the persons found to be dealing with contaminated flood-hit food items. Division Bench comprising Justice Muzaffar Hussain Attar and Justice Ali Mohammad Magrey today observed that It is the duty of the authorities to initiate panel action wherever provided in law against the persons which are found to be dealing with contaminated flood hit food Items. Hearing a Public Interest Litigation (PIL), the court directed the authorities to provide details about it by next date of hearing on December 16. The bench also directed Commissioner Secretary Health and Medical Education Department to file affidavit giving the details in respect of each District of the Jammu and Kashmir where inspections have been conducted. "What makes it necessary for the authorities to give the details is to understand as to whether the inspection has been conducted in all the areas of a particular district. The inspections can be localized to a particular area in a big district and then report filed." Filing of such type of reports, the bench said, would result in non-compliance the court orders. "The effort of the Court is to ensure that contaminated flood hit food items are not sold in any area of the State, providing of details of inspection in the areas in this backdrop becomes imperative." The Division Bench asked the Commissioner to file affidavit giving the details in respect of each district of the state where Inspections have been conducted. "The names of business establishments, distributors, retail details area wise, shall also be provided to the Court, the Division Bench said and directed, "It also needs to be brought to the notice of the Court that besides confiscation of the contaminated food items what other action in accordance with law has been taken against such persons." The directions of the court were followed perusal of affidavit by Gazanfer Hussain, Commissioner Secretary to Health and Medical Education Department, stating that Enforcement Staff of Food and Safety Organization carried out 2566 Inspections of food establishments during the period from 01-11,2014 to 30.11.2014 in various districts of the Stale to ensure that flood hit food items are not sold to the consumers. The Commissioner said that in Srinagar, 169 inspections were carried. However, the court observed no details have been provided as to where the inspections have been conducted, which the establishments were dealing with food items which were inspected. Same is the case in respect of other districts both in Kashmir and Jammu divisions, the court said. It also granted two weeks time to Director CAPD to file the affidavit with regard to directions issued on November 25.
