JAMMU, Feb 12: Even as the State Legislative Assembly is in suspended animation, the MLAs elect particularly some of those representing the Bharatiya Janta Party (BJP) though not yet entitled to the privileges enshrined for the elected representatives as they haven't taken oath as legislators are flouting the laid down norms with impunity by holding meetings with the officers and issuing instructions to them. Few BJP MLAs including Dr Nirmal Singh- MLA elect Billawar, Sat Sharma-MLA elect Jammu West, Kavinder Gupta- MLA elect Gandhi Nagar, Shakti Raj Parihar- MLA elect Doda and Dr Gagan Bhagat-MLA elect RS Pura, who have yet to take oath as legislators since the Assembly has been kept under suspension due to the fractured mandate in recently held polls, in sheer ignorance or belligerent display of authority are not refraining from dictating the administrative officers despite of the fact that they could not do so as the provisions of the rules suggest that elected representatives can not enjoy pay, perks and not even authorized to hold meetings with the administrative officers or be a part of an official function if they haven't taken oath of office. According to the rules, the newly elected MLAs can't have a say in the functioning of the administration till the Assembly is in suspended animation and they take oath of the Assembly on the floor of the House. Official sources told Early Times that when the Assembly is in suspended animation, the MLAs are also under suspension. "Until and unless the elected members take oath, they are not entitled to any perks, can't hold meetings with officers, especially when the Assembly put under suspended animation," an official source said….They can't even inaugurate or be part of any official function as members of the Assembly which is under suspension," he added. However, in complete contrast the BJP MLAs are calling the shots and constantly dictating administrative officers or attending official functions in the capacity of a MLA, in violation of the laws as 'constitutionally' or 'technically' they haven't become a 'complete' legislator. The brazen violation of rules by the BJP MLAs could be gauged from the fact that today MLA elect Jammu West constituency Sat Sharma today while touring Krishna Nagar and Bhagwati Nagar areas of Ward Number 12 and 14 was accompanied by the government officials. A press note issued by Sat Sharma informed that the MLA elect asked the officials to address the problems of the people on top priority. While yesterday, senior BJP leader and MLA elect Billawar constituency Dr Nirmal Singh held a meeting with officials of PWD department. In a press release issued by Dr Nirmal Singh, it was informed that the officials of the department apprised Dr Nirmal Singh of various schemes and projects being taken up. "Dr Nirmal Singh instructed the officials to speed up the project implementation and complete DPR of Dayalachak- Challan road for conversion into four lane highway. Dr Nirmal Singh instructed the officials to the start the second phase of PMGSY works in Billawar constituency," the contents of the press note said. Similarly, MLA elect RS Pura Dr Gagan Bhagat along with Tehsildar RS Pura and EO RS Pura inspected various sites for Waste Management Plant at RS Pura. "Dr Gagan Bhagat and other government officials at RS Pura Sub-district demarked two places at RS Pura sub-division," a press release issued by Dr Gagan Bhagat said.
