No room for PDP-BJP conflict over Article 370

If reports doing the round are to be believed
the issue pertaining to Article 370's future con-
tinues to be one of the sources of friction between the PDP and the BJP as the former wants no tampering with the special status that the state enjoys within the union of India and the latter favouring a debate on the issue for finding out whether Article 370 had proved beneficial for the people of the state or not.
Well on the face of it the controversy does not seem to have any valid ground.First of all the special status that the state of Jammu and Kashmir enjoys under Article 370 stands eroded as scores of Central laws have been made applicable to the state.Under the constitutional provision no Central law can be made applicable to Jammu and Kashmir directly but can be extended to the state with the approval of the state legislature.And during the last 60 years most of the Central laws have been made applicable to Jammu and Kashmir after the state legislature gave its consent.Even the jurisdiction of the Supreme Court,Chief Election Commission and the Comptroller and Auditor General of India has been extended to the state of Jammu and Kashmir.
This is one aspect.The other being constitutional difficulties,according to Muzaffar Hussain Baig,a former Deputy Chief Minister and a prominent constitutional expert,in abrogating Article 370. .There is no way Article 370 can be done away with without snapping the constitutional ties between the state and the Union," PDP MP and a former deputy chief minister Muzaffar Hussain Baig has said Explaining the context of Article 370 and the special position granted to the state, Baig said it was no concession to Jammu & Kashmir but a recognition of the distinct historical, cultural and ethnic status of the erstwhile princely state which had decided to throw its lot with a democratic India at the time of Independence He has said the Article had virtually assumed a permanent status as it could be scrapped only through a resolution by the constituent Assembly of J&Kwhich had ceased to exist long back The PDP patron,Mufti Mohd.Sayeed too has said that even the Parliament cannot scrap Article 370 which actually defines and shapes centre-state relations. If the Mufti and Baig are to be believed there can be no way for scrapping Article 370 without reconstitution of a fresh constituent Assembly where a resolution for its revocation has to be adopted.Hence for the PDP leadership there should be no room for making a noise over BJP's plan on abrogating Article 370.
Yes,the BJP leadership,during the Lok Sabha poll campaign,had favoured a debate on the issue for finding out whether Article 370 has proved beneficial or harmful for the people of the state.And if it was found beneficial it would have to be retained and if it had proved harmful it had to go.During the Assembly poll campaign the BJP did not make abrogation of Article 370 as a poll issue.It did not make any direct or indirect reference to Article 370 in its vision Document.Still it won 25 seats from 37 in the Jammu region.
The PDP did mention the issue by assuring people in the Kashmir valley that if it was voted to power it would not allow any dilution of the spirit of Article 370.Still it could won only 25 seats from the valley and three from the region of Jammu.The National Conference leadership was seen breast beating while voicing concern over BJP's plan on abrogating Article 370.But this breast beating did not help the National Conference in anyway as it could win only 15 seats,the lowest in its poll history.So the PDP leadership should have no fears that forging alliance with the BJP for Government formation could be a sellout.
Since the PDP leadership is certain that neither the Parliament can revoke Article 370 nor the state legislature can recommend for its abrogation it should have no fears over any plan or lack of plan from the BJP side.It is too late for any state Government to have some sell-out with the centre.When it was time for the sell-out the National Conference and the Congress had indulged in that exercise whether it be the 1975 Indira-Sheikh Accord or 1986 Rajiv-Farooq Accord.Now there is no room left for a sellout to New Delhi.
