KU denies info about members of selection committee

SRINAGAR, Feb 3: In an interesting RTI case, the Public Information Officer (PIO) of Kashmir University (KU) has denied information about the selection committee members arguing that disclosure of such information would endanger the lives and physical safety of these members who are senior Professors posted in several universities. The information seeker had sought these details vis a vis conduct of selection process for the posts of Assistant Professors in the faculty of Persian.
Details available with Early Times reveal that one Shabir Ahmad Bhat S/o Gh. Rasool Bhat R/o Audoo Keegam district Shopian had sought the aforementioned information from PIO of Kashmir University under Right to Information Act (RTI). The information was denied and the information seeker filed a complaint directly before the State Information Commission (SIC). The PIO had denied information on the ground that information requested is privileged one, but PIO did not mention any ground of denial vis-à-vis Section 8(1) of the Act. Shabir Ahmad Bhat subsequently prayed before SIC that PIO be directed to provide the information without further loss of time. In compliance to the notice of the Commission, Abdul Rashid Sofi Assistant Registrar Kashmir University (KU) who is also the PIO filed a reply dated 25.01.2015, wherein he stated that the applicant had sought information regarding list of Members of Selection Committee of interview held on 6th & 7th February 2013 for the post of Assistant Professor Persian. The PIO found that the information falls under restriction clause "E" & "F" of Section 8 of RTI Act. Therefore, his office issued a letter to the applicant on 01.12.2015 intimating him that the information sought cannot be disclosed under the purview of RTI Act. Pertinent to mention that clause E & F of section 8 of J&K RTI Act 2009 says that information which is kept under fiduciary relation shall not be disclosed under competent authority is satisfied that larger interest is involved for its disclosure . In addition to it the clause F says that disclosure of such information which would endanger the life and physical safety shall also not be disclosed.
While talking to Early Times State Coordinator J&K RTI Movement Dr Mushatq Ahmad Khan said that PIO has wrongly invoked clause E & F of section 8 of State RTI Act. "How can an information seeker be threat to the life of professors ? This is ridiculous" he said.
