Jammu, Feb 03: J&K high court Chief Justice N Paul Vasanthakumar, setting aside the transfer order of a physical challenged master from SRML Higher Secondary School, Jammu, to the government girls higher secondary school, Pallanwala, terming it bad. The court directive came in a petition filed by Naresh Kumar Jain, a physically disabled master. He was transferred from SRML school to the girls higher secondary school at Pallanwala by the October 4, 2013 order of then director school education. The chief justice observed that statutory provisions give protection to the physically challenged persons statutory right to work at healthy and safe places which can be insisted by them as a matter of right under section 27 of J&K Persons with Disability (Equal Opportunities, Protection of Rights and Full Participation) Act, 1998 and also on the ground of violation of human rights. With these observations, he ordered to set aside the petitioner's transfer order, saying it could not sustain. |
