| GAD files compliance report in alleged land encroachment | | DB directs appellant to file response | | ET Plus Report Jammu, Mar 14: In the much publicized Public Interest Litigation (PIL) filed against alleged land grabbing by certain police officers/ politicians/bureaucrats in connivance with land mafia in various parts of Jammu and Kashmir, as per direction of February 19, 2013 the state filed final decision on the report dated April 24, 2006/ September 2, 2011 of State Vigilance Organisation (SVO). According to the compliance report filed by Additional Secretary GAD Simrandeep Singh in which it has been submitted that a meeting was convened by the Chief Secretary J&K on March 6, 2013 in which various decisions were taken. According to the decisions, the Commissioner/Secretary Revenue Dept will verify the status of 167 kanals and 15 marlas of land owned by S Gurcharan Singh consequent upon the rejection of the PRC by the State Subject Committee. After verifying the status, he shall take appropriate action as warranted under land/rules. The land in excess of what can be retained and possessed by the RB Education Trust in accordance with Agrarian Reforms Act of 1976 should be retrieved and dealt within accordance with the law/rules. Unauthorized encroachers/possessors of 92 kanals and six marlas of State land should be evicted forthwith and the land restored to the state. Compliance shall be reported to the GAD will before the next date of hearing, so that an affidavit is filed in the State High Court. In pursuance of the above decision, the Deputy Commissioner Kathua Vide letter No DCK/SQ/2012-13/1660-61 dated March 9, 2013 has communicated that notice has been given to RB Education Trust for selection of land measuring 100 standard kanals as per the ceiling limit prescribed under the Agrarian Reforms Act 1976. Directions have been given to SSP Kathua and Tehsildar Hiranagar for taking action (evicting illegal encroachers) under section 133 of Land Revenue Act. In compliance, Tehsildar Hiranagar vide his communication No OQ/1211 dated March 9, 2013 addressed to the Deputy Commissioner Kathua has mentioned that the land falling in Khasra Nos, 16, 38 and 39 in village Krandi Khurd Tehsil Hiranagar District Kathua has been got evicted from the illegal encroachers and land so evicted has been put under Sapurdari of Nambardar and Chowkidar of the concerned village with immediate effect. The Division Bench comprising Chief Justice MM Kumar and Justice Dhiraj Singh Thakur after hearing Advocates SS Ahmed and Virender Bhat appearing for the PIL and Advocate General MI Qadiri with senior AAG Gagan Basotra appearing for the state and senior Advocate Sunil Sethi with Advocate Ravi Abrol appearing for the Ch Lal Singh, ordered that compliance report/final decision has been filed by the GAD and a copy of the same has been furnished to the counsel for the appellant, response if any be filed within two weeks. —(JNF) |
