Flexing norms for convenience: GAD despite 'court directions' managed to sideline the norms and regulations just to appease the blue eyed KAS officers

Jammu, Mar 14: Grave manipulation seems to have become core specialty of man running the General Administration Department (GAD). Habitual of taking the system for a ride, GAD Secretary Sheikh Mushtaq ran from pillar to post to get the so-called weak and indefensible 'rebuttal' published. Ask for the reason and one needs not to use his head too much. If the sources are to be believed, Early Time Plus had unveiled the reality of GAD Secretary dancing to the tunes of a powerful KAS officer lobby.
They maintain that what is today tentative would become 'a scared word' tomorrow. GAD has referred to court judgment to convince one and all that the alleged wrong has been done with legal consent from the High Court. But, Early Time Plus has assessed details of the court judgment which reveal that Division Bench vide interim order dated 30-9-2011 had allowed Government to make appointments only on officiating basis in order to run Government offices. If sources are to be believed, court had not specified names of officers to be given important postings but GAD which is known for interpreting rules and regulations, according to taste and suitability of some blue-eyed officers of State administration, went ahead. Citing court order, General Administration Department (GAD) silenced itself over operation of tentative KAS seniority list of issued vide order No: 485-GAD of 2010 dated 21-04-2010.
The high profile KAS officers who enjoy proximity to corridors of powers especially have a close association with Secretary GAD Sheikh Mushtaq Ahmed, managed a list suiting their taste and temperament. Though GAD has been saying that the Government has made officiating promotions from amongst the officers in the impugned seniority list but the same have been made subject to the condition that these shall not create any right, interest or equity in favour of such persons and shall not cause any prejudice to the petitioners in any way. Sources said that the ones who know no way of reaching GAD door are made to suffer for having knocked at the doors of the court. They are denied prize postings and humiliated over trivial issues, said an officer who has been facing the music for having taken on the might of GAD. Such is the influence wielded by these officers that the seniority list issued earlier was not even placed again before the establishment committee that looks into KAS related promotions or before the State Cabinet for final nod.
Instead, the so-called tentative seniority list was issued hurriedly vide order No: 1429-GAD of 2011 dated 14-12-2011, in which these KAS officers placed at the bottom of seniority list were promoted to Additional Secretaries and equivalent ranks. When report broke out, GAD said that the officer have been promoted notionally just for running administration smoothly. However, cases of senior-most IFS officer Vijay Singh Charak and KAS officer, Sheikh Nazir are indicative of the manner in which GAD works especially while fixing seniority of the officers.
It manipulates the cases, accommodates matriculates, elevates them and even orders service transfer, all in complete violation of the service rules. Even orders of the Supreme Court of India are not implemented in letter and spirit. GAD has referred to committees and commissions but it needs not to be elaborated how the blue-eyed rule the roost in Jammu and Kashmir. They are all promoted notionally in public but confirmed in private.
Confirmation orders are never posted on the GAD website. The officers who have lost too much due to this order maintain that they have huge expectations from Chief Secretary Mohammad Iqbal Khandey. They added that being straightforward and honest; Chief Secretary is their only hope. "Let the Government act fair. You cannot discriminate between officers merely because some of them are close to the corridors of power," said a senior KAS officer.
