Did former DIG Farooq Khan conspire to defame former Health Minister Sham Lal?
Leaked inquiry report to media selectively

JAMMU, Aug 21: Aiming to contain growing popularity of then Health Minister Sham Lal Sharma and his brother, MP Madan Lal Sharma, former Deputy Inspector General of Police Jammu-Kathua Range Farooq Khan, under patronage of his political masters had leaked an enquiry report in year 2011, to a section of local media DIG had not delivered the enquiry report's copy in the office of Inspector General of Police Jammu Zone and even had asked KD Singh to file complaint against Sham Lal Sharma. The DIG was evidently appeasing his political masters expecting favours from them in return in terms of his promotion and posting.
This was made clear by former Principal Secretary to Government Home Department BR Sharma (who was made enquiry officer by state government to enquire into the circumstances leading to the leaking of official communication in respect of a land dispute of two Kanals at Lower Muthi Jammu) in his detailed enquiry report. The The enquiry report had unambiguously stated that copy of the "Incident Report" which was meant for DIG Farooq Khan and where the correction in the enclosure column had been made, was the one which was leaked and published in a local press. The enquiry report further maintained that the leakage had taken place only after the correction had been carried out in the enclosure column.
Giving details of circumstances leading to leakage, BR Sharma in his enquiry report has stated that based on "Incident Report" submitted by Dewakar Singh the then SDPO Domana on October 13, 2011, the then SSP Jammu Anand Jain had prepared his own "Incident Report" and submitted the same to DIG JKR Farooq Khan vide his office letter number PA/Incident/27400-01/C dated 21-10-2011.
The "Incident Report" prepared by SSP Jammu was comprising of five paragraphs. While the first paragraphs dealt with the factual backround of the case, the fourth and fifth paragraphs dealt with the telephonic conversation between Minister for Health, Horticulture and Floriculture Sham Lal Sharma and the then SDPO Domana Dewakar Singh, demarcation of disputed land, registration of FIR etc.
However the "Incident Report" as appeared in a news-daily dated 19-12-2011, only the last two paragraphs had been published. The entries in enclosure column of the letter of SSP, Jammu as published in the news daily read as "Encls: CD and not Lvs, the enquiry officer BR Sharma had stated.
The report of BR Sharma further maintained that the perusal of the written statement of Vikas Sharma Selection Grade Constable, the then posted in the PA section of SSP Jammu, revealed that on 21-10-2011, PA to SSP Jammu took a file to SSP for signature and after signature gave him (Vikas Sharma) the letter for dispatch. Vikas Sharma had stated that he had put the dispatch number of the letter and prepared two Xerox copies.
Since the CD prepared on the basis of the recording captured by KD Singh (complainant) on his mobile phone and forwarded by Dewakar Singh the then SDPO Domana along with his incident report dated 13-10-2011, had to be forwarded to the DIG Farooq Khan Jammu, necessary corrections were carried out by Vikas Sharma (SGCT). Therefore the words "Lvs" in the enclosure column were cut/ slashed and the word CD was inserted in its place, BR Sharma has maintained in his enquiry report.
Moreover, former Home Secretary further stated that the original copy of the letter (Incident Report) with the signatures of SSP Jammu was dispatched to DIG, JKR Farooq Khan, along with the CD (Annexure-AG). However due to heavy work load Vikas Sharma forgot to write the word "CD" instead of "Lvs" in the enclosure column of the remaining two photocopies, i.e. the office copy as well as copy meant for IGP Jammu Zone.
Therefore the enclosure column in the Xerox copy of the "Incident Report" meant for the then IGP Jammu, as well as the office copy retained in the office of SSP Jammu continued to read as "Encls-Lvs". However, both the copies of "Incident Report", that was one original with signatures in ink meant for DIG Farooq Khan, along with CD as enclosure as well as the Xerox copy meant for IGP Jammu zone, were delivered in the office of DIG Farooq Khan against proper receipt.
From the above said facts revealed by enquiry conducted by BR Sharma, sources said, it has been transpired that the episode was a bid to defame image of Sham Lal Sharma. It was a well planned conspiracy hatched by DIG Farooq Khan who had also asked KD Singh to file complaint.
"Usually, any complaint is filed before SHO, DSP or SSP but in this case complain was marked by DIG Farooq Khan to Additional SP Jammu with following observation "for immediate necessary action strictly on merit and under law". The additional SP Jammu had in turn marked the above said application to SHO Domana", sources said.
