Court denies bail to Dir Dutta Finance Company

Jammu, Sept 4: Special Mobile Magistrate Electricity Jammu Balbir Lal Jaswal has rejected the bail application of one Gurcharan Singh Dutta Director of the Dutta Finance Company and father of Managing Director of the company.
According to the challan a written complaint was lodged by one Sardar Joginder Singh with P/S Gandhi Nagar, Jammu alleging therein that a number of depositors of various districts of the state had deposited their hard earned money with "Dutta Financiers" Nanak Nagar, Jammu. In April 2011 when some depositors approached the said finance company for payment of interest and even the deposited money for their personal use, the Directors and other officials of the said company refused to pay the deposited money to the depositors. The owners/Directors of the said company namely Gurbachan Singh Dutta and his son Harpal Singh Dutta had been delaying the payment on flimsy grounds although they had a big fleet of Petrol Tankers and Trucks running on Jammu-Leh road and even in Nepal state through the younger son of Gurbachan Singh Dutta namely Amarjeet Singh.
The Finance Company closed its office in Jammu. Some time back, Harpal Singh left for Delhi in connection with some business deal for the land at Kud, but instead of coming back to Jammu to clear the out-standings of so many poor depositors, left for United States of America. The total deposits of the depositors amount to approximately Rs20 to Rs 25 crores. On receipt of this complaint, the instant case was registered in P/S Gandhi Nagar, Jammu. Later on, the investigation of case was transferred to Crime Branch, Jammu.
The Court after hearing senior prosecuting officer VK Sudan appearing for the state observed that the concession of bail in the present case does not warrant as it shall be discontentment among the poor depositors and the accused will be encouraged. The thwarting the course of justice the ray of justice to the poor depositors shall be shattered which is never be the object of the court and rejected the bail application. (JNF)
