Avinash Azad Jammu, Sept 4: The unrelenting struggle of Gurpreet Kour, finally compelled Jammu and Kashmir Health and Medical Education department to terminate the services of controversial probationer surgeon Dr. Javid Iqbal Choudhary (husband of Gupreet alias Smaira) for his alleged involvement in various criminal cases including rape and cheating. The matter was pending with Health and Medical Education Department at Civil Secretariat since January 2013. Responding to case produced by Gurpreet alias Smaira HME department ordered termination of probation and discharged from services of Dr. Javid Iqbal, Consultant Surgeon (under probation) under government order number 500 HME of 2013. The order was signed by Commissioner/Secretary to Government, Health & Medical Education Department, Shaleen Kabra. According to government order, Dr. Javid Iqbal was appointed as consultant surgeon (under Probation) vide Government order number 290-HME of 2011 on June 7, 2011. "Whereas, an FIR No.19/2011 u/s 498-A/109/RPC dated 06.08.2011 was registered against him at Police Station Women Cell, Jammu. The official was placed under suspension vide Director, Health Services Jammu under order NO.DSHJ/ES-3/5766/1274 dated 24.08.2011 and the official remained in police/Judicial custody for 42 days from w-e-f 13-09-2011 to 24-08- 2011", the order read. "The High Court quashed this FIR on 28.12.2011 vide judgment dated 28.12.2011 pursuant to which the official came to be re-instated vide Government Order No: 83-HME of 2012 dated 02.02.2012. Another FIR came to be registered against the official vide No.226/2012 u/s 376, 406,420/379 and 120-B RPC dated 09.05.2012 at Police Station Rajouri and he was again placed under suspension vide Director Health Services, Jammu Order No. DSHJ/607-10 dated 16.5.2012", the order further read. It further reads that one more FIR came to be registered against Dr. Javid Iqbal vide NO.136/2012 dated. 21-11-2Ci12 u/s 107,117 at Police Station Rajouri. "The official came to be re-instated vide Director, Health Services, Jammu order No.DHSJ/ES-3/2240-43 dated 29.09.2012 without prejudice to the final outcome of the FIR No.226/2012 at Police Station Rajouri. Whereas, the matter was examined in the Department and referred to the Law, Justice and Parliamentary Affairs Department for their opinion which have in U.O. No. LD (Ser) 2013/60-HME dated 25.07.2013 opined as under", the order read. It further stated that the returned department is within its rights to suspend the probation period of the doctor and accordingly discharge him from the service if the Department is satisfied that the continuance of the doctor in service is not in the interest of Department. Doctor has remained absent from the duty and this is essential ground for taking action against him and terminate his probation period. Whereas, the official has remained under suspension from August 24, 2011 to February 2, 2012 and from 16.05.2012 to 29.09.2,012 totaling the period as 9 months and 23 days and has also remained in Police Custody for 42 days. Whereas, the official has been involved in cases of criminal nature and has been absent from duty for long durations apart from being in police/judicial custody and, therefore, it is assessed that he is not suitable to be retained in the Government service and his continuance in the services is not in the interest of the department; and Whereas J&K Civil Services (Classification, control and Appeal) Rules, 1956 under Rule 21(1) (b) The government at its discretion terminate the probation period of probation of Dr Javid Iqbal is terminated and he is discharged from the Service with immediate effect. |
