Jammu, Sept 26 : Special Municipal Magistrate Jammu VS Bhou today rejected the bail application of Dr. Raj Sharma owner of Aastha Clinic and Dr. Raman Sharma who were arrested by the police on September 21, 2013 for allegedly involvement of abortion of one of the mentally retarded girl. Special Municipal Magistrate Jammu after hearing CPO Sanjay Kohli with Senior PO Rohit Gupta for the state observed that the police report was obtained and CPO has also filed counter to the bail application and the main allegations against the accused person as per report is that the accused persons namely Dr. Raj Sharma and dr. Raman Sharma being owner of Astha Nursing Home have been arrested on September 20 and 12, 2013 on the allegations that they being the owner of Astha Nursing Home had allowed one of the inmate of the management of Inner Rotary Home Channi Rama got her aborted in Astha clinic Amphalla, Jammu Without informing police and civil administration and hushed up the whole episode and concealed the facts and destroyed the evidence. As the per the evidence the offences u/s 376 (c)/109/315/201 RPC stands fully established against all the accused persons in this case and investigation is in progress and bail application of two accused already declined. Special Municipal Magistrate Jammu VS Bhou after referring judgment of the Apex Court observed that the statement of the mother of victim has yet to be recorded by the police and test identification of the accused persons is also imperatively required to be conducted which can be contradicted only in presence of the witnesses and the accused while in custody and investigation is at nascent stage and apprehension of prosecution that in case of release of accused they may influence the material witness and temper the prosecution evidence is embedded with realism and dismissed the bail application of both the accused.
