Time for Governor to discharge obligation towards Indian Constitution
Omar revolts against the nation

JAMMU, Sept 26: Chief Minister of the state holds a constitutional position. He is under oath to not only work for the welfare of the people of the concerned state but also protect the constitution and maintain the unity and integrity of the country as an instrument of the state. And a Chief Minister who violates the oath of office and preaches secession cannot have any place in the scheme of things of the country. His place should be elsewhere.
Sadly, it has not been happening in India. On the contrary, the custodians of the Indian State are allowing full freedom to the Chief Minister of Jammu and Kashmir so that he could misuse his official position and preach and promote communalism and separatism. Ironically, even the Governor of the state, who is duty bound to discharge his obligations towards the Indian State and ensure that none goes beyond the constitutional confines, too, has abdicated his authority and has been allowing the situation to deteriorate. It appears so. How else should one describe his indifferent attitude towards what Chief Minister Omar Abdullah has been doing in and out of the state legislature for years now to unsettle the settled? Or, how else should one describe the attitude of the UPA Government towards the Jammu and Kashmir Chief Minister, who has been abusing the state constitution and the Indian Constitution on a daily basis.
There is no need to catalogue here all the divisive statements which were made by Omar Abdullah after becoming the Chief Minister. A reference here to just one divisive statement made by him and the indifferent attitude of the custodians of the Indian State, including the Governor, to it would be enough to put the record straight and establish that things have assumed alarming proportions in the sensitive border State of Jammu and Kashmir.
The case on point is the March 25, 2013 assembly statement of Omar Abdullah that Jammu and Kashmir only acceded to India and not merged with it and that by repeating the word "Atoot Ang" you cannot change the political status of the state" and the indifferent attitude of the state Governor and Union Government, which is headed by a Prime Minister who, it appears, cares more for the Pakistani and Kashmiri separatists' interests, to what Omar Abdullah said on the floor of the assembly.
The statement of Omar Abdullah had caused a furore in the country with opposition parties like the BJP taking on both the Chief Minister and the Congress-led UPA Government and urging the Prime Minister to rein in the controversial Chief Minister in the best interest of the country. Panther Party Chief Bhim Singh had even approached the state Governor and urged him to invoke a particular section of the state constitution to dismiss the state government and take the administration in his own hands. As expected, the state Governor and the UPA Government remained unmoved. It's no wonder that the indifferent attitude of the state Governor and the Union Government to what could be termed as an outrageous statement further emboldened Chief Minister Omar Abdullah and the result was that he on Wednesday again reiterated the stand that Jammu and Kashmir only acceded to India and not merged with it and that the state is a political problem that needed a political solution.
"While all the states acceded to the Union of India and then merged with it, the Jammu and Kashmir only acceded and not merged. That is why we have special status, our own constitution and the State Flag…The political issues of Kashmir are not born with the militancy in 1990 but their genesis is long back associated with the partition of the Country when the future of all States was decided other than Jammu and Kashmir," he said while talking to the European delegation led by Ambassador and Head of the Delegation of the European Union to India, Joao Cravinho who called on him in Srinagar.
What the Chief Minister told the European Union delegation was nothing but a revolt against the nation. He sought to internalize the Jammu and Kashmir issue negating all the work done and sacrifices made by the Indian nation in the state. But the question is: Will the state Governor discharge his obligation towards the Indian Constitution and the Indian State by recommending action against the revolting Chief Minister or will the Congress-led UPA Government intervene to salvage the situation in the state by taking a tough stand on the issue? It is extremely unlikely that the authorities would rise to the occasion and do the needful to send a clear message that New Delhi will not tolerate any on-sense.
