| PIL seeking adequate staff for SAC, SVC, SIC | | DB issues notices to Chief Minister, Ors | | Early Times Report JAMMU, Nov 12: The much publicized PIL seeking sanction in corruption cases today took a new turn when in an application seeking adequate staff/infrastructure for J&K State Accountability commission, J&K State Vigilance Commission and J&K State Information Commission, Division Bench of State High Court Comprising Chief Justice MM Kumar and Justice Hasnain Massodi after hearing Adv Sheikh Shakeel Ahmed appearing for the PIL, issued notices to J&K State Chief Minister, Chief Secretary J&K, Commissioner/Secretary General Administration Department J&K, Commissioner/Secretary Department of Law & Parliamentary Affairs which was accepted by Senior Additional Advocate General Gagan Basotra in the open Court. While issuing notices to aforesaid respondents, Division Bench directed State to file objections to the said application before December 10, 2013 and looking into the importance of the issue directed Registry to list this PIL on December 10, 2013. In the application filed by two petitioners Sheikh Mohd Shafi and Professor SK Bhalla, it has been stated that there are 28 posts lying vacant presently in the State Accountability Commission and this information has been divulged in an RTI. From the reply to the RTI it is clear that the smooth functioning of the SAC has come to a grinding halt. It is further submitted that the Chairperson of the State Accountability Commission is without his Principal Secretary and Junior Official has been given additional responsibility to look after the work of Principal Secretary. Not only this, the State Govt has miserably failed to provide the staff for investigating wing of the Accountability Commission thereby stalling the disposal of the Complaints promptly. The petitioners have also alleged that the State has miserably failed to provide adequate staff to the State Vigilance Commission which formally came into existence on February 22, 2013 and the said commission is defunct for the last more than 10 months as 80% of the staff is yet to be posted in the said commission by the State Govt. The Said Commission has more than 300 cases of corruption which it received from J&K State Accountability Commission but there is no headway in the said cases due to non availability of the staff. In the CMA, the petitioners have also alleged another important Commission i.e. J&K State Information Commission is also short of its sanction staff and the said commission is also dying day by day due to in adequate staff and the State Govt has totally exhibited indifferent attitude to the repeated communications of SIC for providing the requisite staff.
