HC asks SMC officials to submit property details, disclose bank account of spouses

Srinagar, Nov 12: The Jammu and Kashmir High Court today directed its civil law enforcing officials to file individual undertakings about the properties owned by them and their spouses before November 21.
A division bench of Justices M H Attar and A M Magrey passed the directions after perusal of details of properties owned by the SMC staffers submitted to the court.
"The details of the property submitted by the SMC do not satisfy the requirements of the court," the bench observed during proceedings of the public interest litigation on illegal constructions that have come up in violation of Master Plan in Srinagar and elsewhere over the years.
The bench directed that the Joint Commissioner, Chief Khilafwarzi Officer, Khilafwarzi Officers, Ward Officers and Building Inspectors submit individual undertakings about the properties owned by senior and mid-level officials and their spouses before registry of the court by or before the next date of hearing on November 21. The court also directed them to disclose bank statement of their spouse and children.
While seeking details regarding the nature and location of the properties, the court directed these officials not to deal in these properties till further orders.
The court also expressed dissatisfaction about the "unclear" stand by the government regarding the policy decision about the violations and directed it to reveal in which direction it was going on violations
Earlier as soon as the case came for hearing, advocate general M I Qadri said that government has referred to experts and it may take some time before the government is in clear position to divulge policy.
Alarmed over the magnitude of Master Plan violations in Srinagar, the High Court had directed the State government to come up with a policy decision by October 24 on how to curb the menace of illegal constructions in the city. Later it granted more time till to disclose the decision.
The court had passed the directions after it had been informed that more than 3000 illegal constructions have been reported from across the city.
The High Court had ordered sealing of 42 buildings in the city which had come up in violation of the Master Plan. It turned down a plea of the affected businessmen to allow them to resume operations till the court decides the case.
However, the court today allowed some of the businessmen to take out the perishable items from their premises within the sealed buildings. It also allowed Jammu and Kashmir Bank to take out records pertaining three business units located in the sealed buildings.
The court was hearing the PIL filed by advocate Mujeeb Andrabi which calls for special attention to Srinagar to make it model city keeping in view its historical importance as well as being the face of the Valley.
