| HC issues notice to petitioner | | PIL on unauthorized construction | | Jammu, Mar 10 (JNF) : The much publicized Public Interest Litigation against alleged illegal construction by the Land Mafia took a new turn when private respondents leveled serious allegations of blackmailing for withdrawing PIL by the petitioner Naresh Gupta, a Division Bench of State High Court comprising Chief Justice MM Kumar and Justice Muzaffar Hussain Attar took serious note of allegations and issued notice to Naresh Gupta s/o Lt KL Gupta r/o H.NO 140 Paharian Street Near Geeta Mandir Jammu to show cause why the penal proceedings be not issued and suitable action taken against him. When the PIL was taken-up, Adv Shah Mohd Choudhary appearing for the private respondents submitted that the Naresh Gupta has been demanding huge cash payment for withdrawal of the present PIL, Upon this Division Bench took serious note and observed that it is most unfortunate if these allegations are authentic and issued notice to Naresh Kumar Gupta to show cause why panel proceedings be not issued and suitable action taken against him. Division Bench also directedprivate respondents to place on record the CD which has allegedly recorded the conversation between Naresh Kumar Gupta and Ors andtranscribe the same supported with an affidavit and same shall also be filed within one week. In a Public Interest Litigation filed by one Naresh Kumar Gupta, he alleged that some illegal and unauthorized construction is being raised by the Land Mafia in the residential area at Mohalla Paharian near Geeta Bhawan Jammu. In the PIL further allegations that the construction is the result of conspiracy with the watch and ward staff, Chief Enforcement Officer, Senior Town Planner and Other Officers of the Jammu Municipal Corporation. |
