Supreme Court order setback for ex-chief N Srinivasan

New Delhi, May 23: Ousted BCCI chief N Srinivasan’s yet another attempt for reinstatement was rebuffed by the Supreme Court on Thursday. Declining to entertain his plea, the court pulled him up for seeking a modification of the restraint order issued in the IPL corruption case. A vacation bench of Justices B S Chauhan and A K Sikri clarified that it could not modify the orders passed by another bench.
“Vacation bench is not sitting to modify orders passed by other judges. What will be more embarrassing for the vacation bench than to modify other judges’ orders?” observed the court. The bench pointed out that the judges, who had passed the restraint order were still there and if the BCCI and Srinivasan wanted modification, they must approach them and request for a hearing. “You were respondent in the case. You were very much present in the hearing. They were not an ex-parte orders and they were passed in your presence,” it said.
Srinivasan had sought modification of the order passed by a bench of Justices A K Patnaik and FMI Kalifulla. This bench had by its orders in March and May directed Srinivasan to keep away from the BCCI affairs till the IPL probe got over.
By its last order, the bench had brought the Mudgal panel back to investigate the role of Srinivasan and 12 players against whom serious charges had been indicated in the previous report of the panel.
Appealing against this order, Srinivasan said that his “unceremonious exclusion” was “too drastic a step and is extremely harsh.”
