Jammu, Nov 18: Following the directions of Chief Judicial Magistrate (CJM), Janipur police lodge and FIR in against two brothers for committing forgery and managed to arrest one of the accused. According to police spokesperson, a case under FIR no 115/16 u/s 120-B, 419, 420, 466, 468 and 471 of RPC stands registered against Jarnail Singh and Manjeet Singh both sons of Sharan Singh, residents of village Koulan, RS Pura. "Police have arrested Manjeet Singh while manhunt to nab Jarnail Singh is on," police added. Quoting complainant, police said, "As per complaint, father of complainant who was Lambardar of village Koulan, Tehsil RS Pura died in the month of July 2016 following which inhabitants of village had approached the revenue authorities to initiate election process for the village Lambardar and the process was also initiated." "The Tehsildar concerned issued a notice dated 12/09/2016 and when Naib Tehsildar came in the village on the scheduled day fixed for nomination, the accused claimed that he had filed a civil suit against the applicant as well as the officials of the Revenue Department." When the notice was shown to the Naib Tehslidar, two persons namely Manohar Lal and Darshan Singh who were stated to have joined the non applicants as co plaintiff in the said suit, openly declared that they had not joined the non-applicants herein as co plaintiff and their names were wrongly written. "During the course of proceedings on 23/09/2016, the applicant as well as aforesaid two persons caused appearance in the court and in presence of applicant, the aforesaid two persons stated that they did not know as to how their names were written in the plaint, when the court had shown the vakaltnama and other papers to them", stated in the complaint. Complainant further stated that Manohar Lal has identified his thumb impression but he maintained that his thumb impression had been obtained by one Jarnail Singh by misrepresentation of facts whereas Darshan Singh when confronted with his signatures had stated that the vakaltnama shown to him did not contain his signatures though his name is written in the vakalatnama and signature are not genuine. Signatures of Darshan Singh on the said vakalatnama with intention to commit fraud and cheating for the purpose of their wrongful gain and for causing loss to the applicant herein. Therefore, the aforesaid non-applicants with the help of some unknown persons had committed the offences punishable under sections 120-13, 419, 420, 466, 468, 471 RPC. From the facts and circumstances of the case, it is apparently clear that the document was forged after hatching a criminal conspiracy with intention to use it in the Court and it was used in the Court. Accordingly, forged document is used in the judicial proceedings, the Court lodge a report with the Police to follow the procedure prescribed under Section 195 read with Section 476 CrPC. |
