JAMMU, July 15 : Division bench today directed Secretary of the Social Welfare Department (SWD) to appear personally before the court to explain steps taken for better care of the Old Age Home.
In a Public Interest Litigation filed by Viklang Chattra Trust for better care of old age home, Division Bench comprising of Justice Tashi Rabstan and Justice Bansi Lal Bhat after hearing Adv Sunil Sethi with Adv Veenu Gupta appearing for PIL whereas Sr. AAG Gagan Basotra for state, directed Secretary Social Welfare to appear in person on July 31, 2014 to give explanation vis-à-vis order dated February 6, 2014.
When the PIL came-up for hearing, Division Bench observed that in terms of order dated February 6, 2014; Secretary Social Welfare Dept has filed compliance report and after perusal of it, Court observed that to find it whether it is actually what the Court has asked for and after gone through the same, Division Bench observed that from a plain reading, it reveals that Secretary Social Welfare Dept has not complied with the direction in letter and spirit.
Upon this, Division Bench directed Secretary Social Welfare to appear in person on July 31, 2014 to tender his explanation vis-à-vis order dated February 6, 2014.(JNF) |
