Court orders overlooked by land grabbers
Illegal construction, encroachment going on in Reasi

JAMMU, July 15: In a glaring instance of land grabbers enjoying political and administrative patronage, illegal construction and encroachment is going on in connivance with officials of Revenue Department in Seela village of Reasi District.
Illegal construction as well as encroachment is going on in breach of court stay. Documents in the possession of Early Times divulged that a piece of land measuring 558 Kanals an 12 marlas under survey number 744 of village Seela in Reasi district was recorded as GairmumkinKasi.
Moreover, since the matter was Sub-Judice, some influential people of the area in connivance of officials of Revenue and Police Departments have started levelling and construction work on said land. On October 21, 2013: Justice TashiRabstan of High Court under OWP no. 1436/2013 and CMA number 1970/2013 had ordered that status quo as on date should be maintained till next date before the Bench.
According to revenue record the land was reserved for grazing fodder. "Under the Big Landed Estates Abolition Act (BLEA) 1949, the land was classified as GairMumkinKassi, was exempted from the operation of the act. By virtue of the act, a ban was imposed on the transfer of such land. Interestingly, Raghunath Singh son of Kashmir Singh resident of village Seela, one of the owners of the said land in connivance with revenue officials' mutated/ transferred a number of plots of land which belong to other owner to other parties and also managed to hand over the possession.
In the meantime, KamleshMisri son of IqbalNathMisri, who is also owner of around 109 Kanals of land under said survey number, noticed illegal activities carried out by some outsider and had approached Settlement Commissioner Revenue, challenging mutation made by Revenue officials in 2004. During hearing of the case, Settlement Commissioner Revenue, observed that the mutation was violating the provision of BLEA Act as well as section 13 of the Agrarian Reforms Act, 1976. The entries were made by the Patwari during Rabi 1988 are also violation of provisions of the law.
Kamlesh Misri, who had approached pillar to post seeking vacation of mutated GairMumkinKassi land, told Early Times that he has appraised Revenue and Police departments about violation of BLEA Act and has sought administrative action for maintaining law and order but nothing has been done so far. He alleged that Revenue and Police officials are hand in glove with land grabber and instead of taking action against them the administration was defending them.
