Delhi firm dupes Tourism Department | Company defaults after receiving full payment in advance; Three legal notices sent till date: Director Tourism | | Arun Singh
Jammu, Aug 17: Flouting the set norms, Tourism Department made advance payment of Rs 12.45 lakh to a New Delhi based company for purchase of river rafting equipments without a formal agreement with the firm six years ago; as a result, department could neither get supply of the order placed nor succeeded to recover the amount till date. Sources told Early Times that a firm M/S Indian Rafting Foundation, New Delhi based firm had approached Director Tourism Jammu in February 2007 for supply of equipment to build infrastructure for river rafting in the state. They further said that Director without following the codal formalities i.e. open tendering system for selection of the supplier and without executing any agreement with the supplier placed supply order with the firm in April 2008 for supply of three AVON 14 ft Raft with three Cross Tubes along with accessories valuing Rs 12.50 lakh and accordingly released an advance payment of Rs 12.45 lakh in May 2008 in favour of the firm. The firm had not supplied any equipment till date, they added. The department except for issuing October 2010 a legal notice had not been able to take any action for recovery of the amount due to absence of a formal agreement with the firm. Thus release of advance payment without following the codal formalities and without ascertaining credentials of the firm resulted in loss of Rs 12.45 lakh, sources said. When contacted the Director Tourism Soujanay Sharma in this regard, he told Early Times that a court case had been lodged against the firm, and three legal notices have been sent to firm till date but department has not get any response from the firm in this connection. "We connected the company telephonically nearly two weeks ago asking them to give either the delivery of equipments or refund of the amount given to the firm as advance," he said further adding that I have categorically told the company that department will lodge FIR incase it failed to fulfill the demand. We are also contemplating to send a team to New Delhi to meet the officials of M/S Indian Rafting Foundation to settle the matter and to tell them about legal consequences if they did not agree to give us supply or refund the amount paid as advance, he added. |
