Petition against commercial activities in residential houses at Gandhi Nagar
DB directs JMC Commissioner to take action

Jammu, Oct 15: In a petition filed by LK Kouchar and Ors who were residents of Block A Sector C Gandhi Nagar Jammu submitting that private respondents namely Arun Bakshi and Suresh Bhawani Chairman/MD Jet King have opened six commercial offices in a residential house No 17 A/C Gandhi Nagar Jammu as under the name and style as NG Properties, Steeping fashions, Placment overseas, Xclusive Beauty Parlour, Ami Soft Academy and Sakun Educational Constultants.
In the petition, petitioner submitted that such offices have been opened in the residential house without there being any permission from concerned authority (Municipal Commissioner Jammu Corporation Jammu), as such in violation of Master Plan.
During the course of arguments Adv Parag Sharma appearing for the petitioner submitted that it appears that private respondent are hand-in-gloves with the concerned authority (JMC Commissioner) whereas by now they would have been served with the requisite notices by JMC Commissioner under J&K Control of Building Operation Act. Adv Parag Sharma further submitted that this Court has already taken a serious note of violations of Master Plan being carried out within the limits of Municipal Corporation Jammu in WPPIL NO 1/2014.
Division Bench Comprising Justice Virender Singh and Justice Bansi Lal Bhat today after hearing Adv Parag Sharma at length observed that it is once again a wake-up call for Commissioner Jammu Municipal Corporation to perform its statutory obligations in terms of J&K Control of Building Operation Act and issued notice.
Division Bench further observed that it goes without saying in case private respondents are running commercial activities in a residential house without there being any permission or in violation of Master Plan, JMC Commissioner would take appropriate action against them in accordance with land and furnish report in this regarding before the next date of hearing.
