State High Court stands by those ravaged by floods in J&K | | | Early Times Report
Srinagar, Oct 15: The Division Bench of the State High Court coming down strongly on various insurance companies has remarked, "Don't try to act smart. We have directed you politely to implement the Court order, we also have the power to initiate contempt against you and ensure you comply with our orders." The observation by the Hon'ble High Court came a day after the insurance companies tried to agitate an earlier order of the State High Court in the Supreme Court regarding the payment of 95% interim compensation to those flood affected people who had insured properties and stocks up to Rs.25 lacs and 50% as interim compensation to those who had insurance covers exceeding Rs.25 lacs. While dismissing the plaint of the insurance companies against the State Division Bench order, the Supreme Court bench said not a single line of the J&K High Court order in this matter would be changed. "We have seen the devastation with our eyes", the Chief Justice of India remarked while dismissing the insurance company plea. It is very strange that the very fact against which people take insurance policies should be questioned at a time when the tremendous devastation caused by the floods in the State is visible even to those who might not have been directly affected. It has always been the practice of the insurance companies to beg for premia and insurance covers in times of prosperity and when adversity strikes those who have trusted these companies they engage people in litigation and delay. The State High Court has always been the last resort for those who are denied justice from every other quarter. It has always been the State High that has come to rescue of the poor and those whose only option to seek justice is by knocking at the doors of the judiciary. Whether it was the 2005 earthquake or any other individual instance where justice is denied or delayed by the government or private companies, the State High Court has stood by its constitutional duty and authority. "We can show the right doors to your CEOs if you fail to comply with our orders." This remark of the State High Court must end all delaying tactics adopted by the insurance companies to deny their customers the legal right to be compensated. While the hon'ble Judges of the State High Court are only discharging the duty to which they are bound by the oath of office, nobody can deny the fact that after God one always looks at Judiciary for justice and the judiciary has never failed those who seek justice from it. State High Court would always be remembered with reverence and high dignity whenever the horrors of 2014 floods are narrated to posterity. |
