Bail denied in 'mentally retarded' rape case

Jammu, Nov 18 : Presiding Officer Fast Track Court Y P Kotwal rejected the bail application of one Bhagwan Dass who was facing trial in rape with mentally retarded girl.
After hearing both sides, Presiding Officer Fast Track Court Y P Kotwal observed that rape is one of the most heinous crime against a woman and not only insults womanhood, violates the dignity of a woman and it also violates to the life guaranteed under Article 21 of the Constitution of India thus with these observations Court rejected the bail.
According to the police case that on June 29, thuis year brother of the victim lodged a written complaint in the police station alleging that at about 3:30 PM while he passing through a Khad (nullah) near his house on June 27, he saw accused committing rape with his sister who is mentally retarded and on notcing him, the accused fled away. Upon the said report police registered a FIR and after completion of investigation challan was presented.(JNF)
