Info denied under RTI, SIC lambasts SDM (East)

Srinagar, Jan 29 : The State Information Commission (SIC) has lambasted the Sub Divisional Magistrate (SDM) Srinagar East for not responding to its notice in connection with an RTI case wherein information about encroachment of a road in Srinagar's posh colony was denied by the officials of Revenue department.
Details available with Early Times reveal that one Nazir Ahmad Najar R/O Brein Nishat Srinagar filed a second appeal before the State Information Commission (SIC) on 11.12.2015 stating that he approached PIO/Tehsildar Khanyar seeking information as per his RTI application dated 27.07.2015. He alleged that no information has been provided within the specific time period. Najar then filed First appeal before the Sub Divisional Magistrate (SDM East ) who is also the First Appellate Authority (FAA) on 19.09.2015 seeking same information, but no information was provided. The appellant finally requested the Commission to Intervene.
The information seeker had sought to know under RTI, the width of the road from Manzgam Brein to Pahloo Brein, Actual width at this time, the detail of encroachment if any, action of department taken to evacuate the and copy of the action taken against encroachers.
In compliance to the directions of the Commission conveyed on 29.12.2015, Xen Construction Division II Srinagar disposed of the RTI application by providing response to all points of RTI application to the appellant. Xen informed commission (SIC) that Point 1 & 5 pertains to Revenue Department. Tehsildar Khanyar submitted during the proceedings that the said Road is not entered in Revenue Records and therefore no information can be provided. Accordingly, Tehsildar Khanyar was directed to inform appellant the status of this road as per records within one week. SIC in its order ruled, "The Commission has taken a serious view that SDM (East) Srinagar has not bothered to file reply to the notice of the Commission, thereby implying noncompliance. Therefore, SDM (East) Srinagar is directed to explain as to why action as per the provisions of the Act shall not be taken against him for not filing reply/counter statement His explanation, if any, should reach the Commission within two weeks. Registry shall put up other cases where FAA/SDM (East) Srinagar has not disposed of the Appeal as required under Section 16 of the Act. With the above directions, the appeal filed before the Commission is disposed of".
