FIR against SP, SHO: HC rejects plea by Handwara girl's mother | | | Early Times Report Srinagar, May 12: A division bench of the state high court today rejected claims of the Handwara girl's mother that her daughter, husband and sister were 'illegally detained' by police, observing that such contention was 'unjustified and uncalled for.' "The respondents 6 and 7 (SP and SHO Handwara) have made it clear that they had never detained petitioner's daughter, husband and sister. Instead it was at the request of the petitioner's husband that they were kept in protected place of their choice. When it is so, there is no question of illegal detention or illegal confinement, as a result whereof, there can't be any cause for directing registration of case against the respondents 6 and 7," a division bench the court comprising Justice Mohammad Yaqoob Mir and Justice A M Magrey said in the judgment on the petition by the girl's mother. The court also rejected other prayers of the petitioner including one of the investigation into the role of army in 'creation and release of the video' showing the girl exonerating the soldiers for the molestation attempt on April 12 at Handwara. The government had reiterated in its objection to the petition that the girl approached police station Handwara on April 12 at around 3:15 pm, stating that she was molested, dragged and slapped by two local boys while she was coming out of a public lavatory in the main chowk Handwara. She identified one of the boys as Hilal Ahmad Banday who according to her was yelling "Kya Kashmiri Mar Gaye Hai" (have Kashmiris died), the reply said. The other boy, she said, is not known to her but she could identify him, the police said. Accordingly, the reply said, a case (FIR No. 130/2016 u/s 509, 354,341) RPC was registered. Massive protests had been witnessed in Handwara town of north Kashmir on April 12 following allegations that the girl was allegedly molested by an armyman. Three persons were killed in security forces firing on protestors on the same day, while two other persons were killed in similar action over the next three days of protests. |
