| Modified version of 73rd amendment may be ncorporated in J&K Panchayati Raj Act | | | ET Plus Report Jammu, Mar 19 : Latest reports indicate that the National Conference led Government plans to incorporate some clauses of the 73rd amendment in the state Panchayati Raj Act. Official sources said that the Law Department is giving final shape to the recommendations given by the Government set up committee and from the state unit of the Congress. Sources said that the final report would be a mixture of the recommendations of the committee and the one from the Congress. According to these sources, the Government, especially the National Conference leadership, does not want to give any impression to people that it had extended the central Act to the state. The NC leadership believes that clear extension of the 73rd constitutional amendment to the Pachayat Raj Act in Jammu and Kashmir would amount to further dilution of the spirit of Article 370 of the constitution of India that grants special status to the state within the union of India. And for extension of any central law to the state there is need for approval from the state legislature. Reports said that besides the Congress the elected members of the Panchayat committees had mounted pressure on the NC leadership for incorporating 73rd constitutional amendment in the Panchayat Raj Act. The Panchayat committee members had threatened to quit because in the absence of empowering them their survival was under severe threat from the militants. According to these reports, the AICC Vice President, Rahul Gandhi, who has favoured empowerment of Panches and Sarpanches in Jammu and Kashmir, too had suggested to Omar Abdullah to amend the Panchayat Raj Act. Official sources said that the State Government was shortly embarking on initating a process for empowering State Panchayats in the light of 73rd Constitutional Amendment. Under attack from opposition for allegedly delaying incorporation of the provisions of the amendment in the state Panchayat Raj Act, Minister for Panchayat Raj Ali Muhammad Sagar has said a "final report" based on the recommendations of a government committee and suggestions from Congress was being examined by the Law Department. The final report would be submitted to the cabinet for clearance. |
