Jammu, Sept 19: Principal Sessions Judge Jammu Kartar Singh acquitted Ghulam Ahmed Mir and Riaz Ahmad Khan both residents of Thanamandi, alleged militants of Hizbul Mujahdeen as prosecution failed to prove its case. According to the police case on 2 September 2004, the accused were found travelling in a Sumo which was intercepted by the Army at Manial Gali Rajouri and Ghulam Ahmed Mir, Raiz Ahmad Khan, Hazra Begum and two children, one boy and one girl aged eight to 10 years, were found travelling in the vehicle. The said the vehicle was brought to Manial gali under escort, where it was checked by the security forces and on its checking Rs 57240, one telephone diary, visiting card, five money order receipts, letter pad of Hizbul Mujaheedin, driving licence, one love letter written by Saima Khan and passport application receipt of Riaz Ahmed Khan were recovered from the accused. The recovery was suggestive of objectionable activities adopted by the accused in order to transfer funds to terrorist from one place to another. On the written report of the complainant, Major Adjutant 13 Rashtriya Rifles Regiment, FIR No. 129/2004 for the commission of offence falling under section 3/E.A.O was registered against the accused and investigation ensued. During investigation, the police seized the recovered currency notes as well as other articles and apprehended the accused on the spot. After investigation, the final report was submitted in this court. The Court after hearing advocate Rupak Ratta appearing for the accused observed that the conclusion is irresistible that there is not even an iota of incriminating evidence against the accused. "They are, therefore, acquitted of the charge framed against them," the judge ordered. (JNF) |
