| HC issues notice to Chief Secretary, ors | | Promotions under reservation rules challenged | | Early Times Report
Jammu, Oct 7(JNF): In a petition filed by Mrignayani & ors challenging the reservation rules in promotion to the teachers belonging to reserved category, Justice Dheeraj Singh Thakur after hearing Advocate Vilakshan Singh appearing for the petitioner issued notice to State of J&K Through Chief Secretary, Director School Education, Commissioner/Secretary School education and other promotees returnable within four weeks.
In the petition it has been submitted that the official respondents have vide various orders promoted the teachers belong to reserved categories as Masters by giving them benefit of reservation in promotion, as provided in Chapter-III (section 6 to8) of J&K Reservation Act 2004 and the J&K Reservations Rules 2005 particularly Rule 9 and 10. It is also submitted that 77th constitutional Amendment Act is not applicable in the J&K State and judgment of the Apex Court titled Indira Swahney still holds good within the territories of the State of J&K. |
