SIC directs PIO Electric, M&RE to clarify position
Alleged misappropriation of daily wagers' salary

Jammu, Oct 7: The State Information Commissioner J&K, issued notice to Public Information Officer (PIO) Electric, M&RE Division Kathua and sought explanation from him that why penalty proceedings under section 17 of State RTI may not be initiated against him for his failure to provide complete and correct information to the information seeker. The Commission also reprimand FAA, Electric Maintenance and RE Division Kathua for his indolent approach in discharging his responsibilities.
The SIC took serious note of the conduct of Electrical, M&RE Division Kathua officials on the complaint of information seeker namely Shiv Shankar Sharma who had filed RTI to Electrical, M&RE Division Kathua.
Seeking information for public interest including details of daily wagers engaged by department along with their complete bio-data and authority who engaged them, mode of their payment, amount of expenditure made for payment of wages to these daily wagers engaged on need basis and latest status of each daily wager so engaged after the issuance of circular No 09-GAD of 2013 dated 26.03.2013
When the information seeker did not get the correct information from the concerned PIO after lapse of 30 days, he preferred 1st appeal before Electric Maintenance and RE Division Kathua, but, he too failed to provide information to information seeker after elapse of 45 days. Getting nothing, the information seeker file complaint to second appellant authority viz SIC .
The competent authority after going through the complaint came to know that the PIO has given incomplete information to the information seeker and also fail to provide information with regard to total amount of expenditure incurred under the scheme of payment of wages to daily wagers on need basis and latest status of daily wagers. The Commission further directed to the PIO to submit the latest status of each daily wager so engaged after the issuance of Circular No 09 of GAD of 2013 to the commission.
In its decision having File No SIC/J/A/208/2013/508, the Commission observed " These points were raised in appeal and even before FAA vide Appellants first appeal but unfortunately, the FAA not appreciating the import of his public authority as laid down in the act under section 16 has not appreciated the gravity of his responsibilities. The Commission shooting notices to the PIO that why penalty proceedings under section 17 of the State RTI Act may not be initiated against him with the direction to reply to the Commission within 15 days".
