| HC hears petition seeking quashment of Kishtwar roit case | | HC calls record of trial court, issues notice | | Early Times Report
Jammu, Oct 7(JNF): Taking cognizance of a petition seeking quashment of the Kishtwar riot case, the High Court today called record from the trial court and issued notice toPrincipal Secretary Home, SSP KIshtwar, SHO P/S Kishtwar and Supt District Jail Kishtwar returnable within two weeks. The petitioner while giving background of ten August 9 riots said posters glorifying JKLF founder Maqbool Bhat and Afzal Guru had appeared in Kishtwar a few days before the riots actually took place. There were also posters which fuelled communal tension and anti-India feelings. It is pertinent to mention that the entire investigation in the matter was stage-managed and mere eyewash. The investigation into the incidents which occurred in Kishtwar were investigated by the SIT in a totally unfair and partial manner thereby giving clean chit to the trouble creators/persons who were actually prima-facie involved in the incident. One person namely Arvind Raj was also murdered/killed in the aforesaid rioting incident by the miscreants/anti-nationals and the father of the deceased on finding that no impartial investigation in the matter has been done by the police/SIT, has already approached this Hon'ble Court by filing writ petition OWP No. 1177/2013 titled Des Raj Bhagat vs. State of J&K and others in which he has prayed for conducting of a thorough probe/investigation into the incidents which occurred in Kishtwar through the Central Bureau of Investigation in view of involvement of high profile persons including politicians/ bureaucrats and high rank police officers/officials. This Hon'ble Court has already taken cognizance of the said writ petition and while issuing notice to the respondents has directed the Deputy Commissioner, Kishtwar to file status report vis-à-vis investigation being conducted and seeking quashment of the present case or directed direct transfer of criminal challan titled State of J&K v. Sajan Singh and others for commission of offences punishable under section, 435, 436, 427, 332, 336, 353, 17, 148 and 149 RPC from the Court of Learned Sessions Judge, Kishtwar to any other court of parallel competent jurisdiction at Jammu in view of hostile and surcharged atmosphere in Kishtwar as against the petitioner and other accused persons being the members of minority community. |
