| HC directs IO to record statement of Girl | | Zanana Park burn case | | ET Report
Jammu, Oct 11 : In a petition filed by one Sanjay Sharma seeking quashment of the order of Special Municipal Mobile Magistrate Jammu and Principal Sessions Judge Jammu whereby the Principal Sessions Judge upheld the order of Special Municipal Mobile Magistrate Jammu for recording the statement of the Girl burned at Zanana Park.
Justice Janak Raj Kotwal of J&K High Court Jammu Wing after hearing Sr. Adv Sunil Sethi with Adv Ravi Abrol appearing for the petitioner issued notice whereas Adv AK Sawhney accepted notice on behalf of private respondent.
In the meantime, Justice Janak Raj Kotwal directed that investigating officer shall go ahead with the recording of the statement of the victim in terms of section 161 CrPC r/w section 164-A CrPC as the case may be, making clear that there is no bar in recording the statement of person even if FIR has been registered on her statement. Court further clarified that this observation is, however, subject to final outcome of the petition and further directed that the statement recorded by the Investigating Officer shall be subject to outcome of the petition.
