Srinagar, Oct 19: Central Bureau of Investigation has sought dismissal of a contempt petition against it in Jammu and Kashmir High Court regarding Surankote fake encounter case in which 19 persons, including women and children were killed 15 years ago. In the statement of facts filed before the high court earlier this month, the CBI submitted before the court that it has already registered an FIR and assured the court that the investigation will be taken to its logical conclusion with all fairness. On November 22 last year, a single bench comprising Justice Muzaffar Hussain Attar had ordered CBI inquiry into the extra-judicial killing in Surankote area of Poonch on a plea by families of the victims seeking a re-investigation. The CBI is learnt to have written to the Chief Secretary of the state and army seeking documents and records related to the alleged fake encounter. On the intervening night of August 3 and 4, 1998, 19 persons-six males and 13 females -- were killed at the house of Hassan Mohammad Sheikh at Sailan village in Surankote. The police, in its FIR, had blamed foreign militants for carrying out the killings but an inquiry conducted by the State Human Rights Commission in October 1998 ruled out the involvement of militants. The SHRC also recommended an inquiry into the case. The families of the victims had filed a petition for re-investigation in the case before the High Court in 2011. CBI had recently claimed that the matter was related to terrorism and should be probed by National Investigation Agency. "It is most humbly submitted that CBI mostly deals with cases of corruption involving offences under prevention of corruption act 1988 and JK Prevention of Corruption Act. The killing related cases are not generally investigated by CBI and Government of India has set up National investigation Agency as nodal agency which has the mandate to investigate cases as mentioned herein (Sailan massacre)," the CBI has said in its compliance report filed in the High Court in June. "It is further submitted that petitioners have also prayed for reinvestigation by CBI or any other authority which the court may feel just and proper," the CBI had said, adding, "The ends of justice will be met if the case is transferred to NIA which is a specialised agency meant to investigate such (militancy) related cases." The report by CBI further reads, "That the facts and circumstances as per the FIR reveal that the barbaric and inhuman act was allegedly committed by Pakistan based (militants). The matter should ideally be investigated by NIA created by Government of India under an Act of the Parliament."
